These Terms of Service ("Terms") govern your use of the website premecosta.boats and the interior design services provided by Preme Costa Studio S.L. ("Company", "we", "us"), Carrer de Pau Claris, 120, 08009 Barcelona, Spain. By using our website or engaging our services, you agree to these Terms.
1. Website Use
Content on this website is provided for general information about our interior design services. We strive for accuracy but do not warrant that all information is complete or current. Portfolio images represent completed work and may not reflect items currently available from suppliers.
2. Service Engagement
Design services are provided under separate written contracts specifying scope, fees, timeline, and deliverables. In case of conflict between these Terms and a signed contract, the contract prevails. Proposals are valid for 60 days unless otherwise stated.
3. Fees and Payment
All fees are quoted in euros and include 21% Spanish VAT unless noted as net. Payment terms are specified in project contracts. Late payments may incur interest at the statutory rate under Spanish law. We reserve the right to suspend work on overdue accounts exceeding 30 days.
4. Intellectual Property
All design concepts, drawings, specifications, and documentation remain our intellectual property until full payment of all invoiced fees. Upon full payment, clients receive a licence to use deliverables for the specified project. We retain the right to photograph completed projects and use images for marketing unless otherwise agreed in writing.
5. Client Responsibilities
- Provide timely access to properties and accurate information about requirements
- Obtain necessary permissions from landlords, community administrators, or authorities
- Review and approve deliverables within agreed timeframes
- Make payments according to contract milestones
6. Limitation of Liability
Our liability is limited to the total design fees paid for the relevant project. We are not liable for indirect, consequential, or punitive damages. We carry professional indemnity insurance of €2,000,000. Construction and installation work performed by third-party contractors is their responsibility; we provide coordination services as specified in contract.
7. Cancellation
Either party may terminate a project contract with 30 days written notice. Client shall pay for all work completed and expenses incurred to the termination date. Deposits are non-refundable once concept design work has commenced.
8. Governing Law
These Terms are governed by Spanish law. Disputes shall be submitted to the courts of Barcelona, Spain. Consumers resident in the EU may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
